Dispute resolution week is a big week for Cafcass, because it highlights one of the mainstays of our practice. Just as World Mental Health Day and National Adoption Week shine the spotlight on important social issues, which otherwise might slip further under the radar, so Dispute Resolution Week reminds us that in the vast majority of public and private law cases we deal with, there are disputes, big or small, to resolve.

For Cafcass, private law and public law are equally important. Children in both types of case have an equal right to our help. Having spent considerable time over the last year reviewing the public law framework, we have now turned our attention to private law. Along with our partner agencies, we are updating the 2010 Private Law Programme in the run-up to new legislation next year.

In working with the most vulnerable children and adults in the country, social workers, along with probation officers, the police and a host of other professionals, are charged with protecting people from themselves and the public from harm. We know that most harm comes from those closest to people, from whom they least expect – at least when it starts.

The first two months of 2013 have seen more record volumes of care applications and private law applications to court, the latter no doubt in order to start some cases before the Legal Aid eligibility changes take effect in April. Despite these increases, we have also been completing record numbers of cases through faster working.
